Welcome to ExpensiVibe (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your relationship with our website https://expensivibe.com/ (the “Service”) and your use of the services we provide. By using our Service, you agree to comply with and be bound by these Terms.
2. Services
We provide web design and development services, including but not limited to website creation, maintenance, and redesign. The scope of work and specific deliverables will be outlined in a separate project agreement.
3. Acceptance of Terms
By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our services.
4. Payment Terms
a. Pricing: All prices are quoted in [currency] and are subject to change without notice unless otherwise specified in the project agreement.
b. Payment Schedule: Payments are due as per the agreed schedule outlined in the project agreement. Typical payment terms include a deposit before commencement, progress payments, and a final payment upon completion.
c. Payment Process:
Option 1: Full Payment: Payment for services must be paid in full prior to commencement. You can pay at the checkout when placing an order for our services on the website. We will send an invoice for you to pay directly into our bank account. If you prefer to pay by credit card, just let us know; however, you will be responsible for covering card processing fees. Our services will only commence after payment is received. If we commence work prior to receiving payment, this does not in any way prejudice our right to seek payment.
Option 2: Installment Payment: If you prefer not to pay in full upfront, you can opt for installment payments. A deposit of 50% of the total cost with an additional 25% of the original price is required before commencement. The remaining balance can be paid once the design phase of the project is finished and before development begins.
5. Pause, Cancellation, and Refund
We appreciate that you like to buy the stuff we build. We also want to make sure you have a rewarding experience while you’re exploring, evaluating, and purchasing our products. If, for any reason, you are not completely satisfied with any good or service that we provide, don’t hesitate to contact us, and we will discuss any issues you are experiencing with our product. ExpensiVibe reserves the right to deny refunds at its own discretion without notice or liability to the Client. Refund requests are assessed on a case-by-case basis.
a. Pause in Services: Clients may request a temporary pause in the project by providing notice. We will accommodate such requests to the best of our ability, but it may impact the project timeline and costs.
b. Cancellation by Client: If the Client wishes to cancel the project. In such cases, clients will be responsible for payment for all work completed up to the date of cancellation.
c. Refunds: Refunds are not typically provided for work already completed. However, we may consider partial refunds for uncompleted work on a case-by-case basis. If a refund is deemed appropriate, a 25% non-refundable production fee will be assigned to the remaining billable period.
6. Client Responsibilities
a. Content Provision: Clients must provide all necessary content, including text, images, and other media, in a timely manner.
b. Feedback and Approval: Clients must provide timely feedback and approval on project milestones.
c. Third-Party Licenses: Clients are responsible for acquiring any necessary licenses for third-party software, images, or other content used in the project.
7. Timeline
We will use reasonable commercial endeavors to deliver the services in accordance with any agreed timeframes, but we do not guarantee any timing estimates, and we will not be in breach of our obligations if we fail to meet any such timelines.
8. Warranties and Liability
a. Service Satisfaction: If you are not happy with our services, to the extent permitted by law, we will not provide you with a refund but will supply you with the services again, within reason, to meet your original brief until you are satisfied with the services.
b. Changes to Brief: If your brief has been amended from your original brief, then you accept that the additional work will need to be quoted first. If you accept the quote, we will send you an invoice to be paid before we commence the new design work.
c. Partial Refunds: In the unlikely event you remain unhappy with our designs after unlimited revisions, ExpensiVibe may agree to a partial refund, taking into account work already undertaken by ExpensiVibe designers. Any request would be considered on a case-by-case basis, and no guarantees regarding refunds are made.
d. Final Design Approval: If you have approved the designs and we have sent you the final design files, the project is considered complete, and no more design revisions will be made. Once you have received the final design files, you have accepted that the design project is complete as per the agreement, and you accept that we will not provide you with a refund if requested.
e. Service Warranty: Our services are provided “as is” without any warranties or guarantees of any kind.
f. Liability Cap: Our total liability under any agreement for the provision of services is limited to the total fees paid by the client for the specific project.
g. No Guarantee of Results: We do not guarantee that our services will provide any specific results. In particular, and without limiting the foregoing, we make no guarantees, warranties, or representations as to sales or revenue that may be achieved or that you will receive any new or increased numbers of customers as a result of our services.
9. Confidentiality
We respect the confidentiality of your information and will not disclose any confidential information without your prior written consent, except as required by law.
10. Intellectual Property
a. Ownership: Upon full payment, ownership of the final website design and development work is transferred to the client. However, we retain the right to showcase the project in our portfolio and promotional materials.
b. Showcasing Design Work: ExpensiVibe reserves the right to share design work on digital channels, including social media, website, etc., unless otherwise agreed upon. The Client reserves the right to issue an NDA between themselves and ExpensiVibe, which would void ExpensiVibe’s right to share or discuss the Client’s work publicly.
11. Termination
a. Termination by Client: Clients may terminate the project at any time by providing written notice. In such cases, clients will be responsible for payment for all work completed up to the date of termination.
b. Termination by Us: We reserve the right to terminate the project or suspend services if the client fails to comply with these Terms or the project agreement.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the revised Terms.
